Terms of use
The contract between you and us. It is short because the service is simple, and it also says what we do not guarantee.
1. Who you are contracting with
The MemoryPilot service is published by Brian-Clarky Biendou, sole trader (entrepreneur individuel), 8 rue de la Mayenne, 31100 Toulouse, France, SIREN 919 153 189 · SIRET 919 153 189 00015. Using the app or this website means accepting these terms.
2. What the service does
MemoryPilot records information you entrust to it, organises it, gives it back on request and triggers reminders. It runs on iPhone and on Android, in French and in English.
3. What you may put in it, and what you may not
You remain the owner of everything you entrust to it. We claim no right over it and do not exploit it, other than to deliver the service to you.
You undertake, however, not to use it to:
- store unlawful content, or someone else’s credentials or data obtained without their agreement;
- attempt to access another account’s data, or to circumvent usage caps;
- automate calls to the service beyond reasonable personal use.
The free account is capped on the number of model calls per day. The cap protects the service against automated use; it is not a commercial manoeuvre: it sits far above what normal use reaches.
4. Prices, subscription, cancellation
| Plan | Price | What it gives |
|---|---|---|
| Free | 0 € | Stop trying to remember, starting now |
| Yearly | 49,99 € | Everything in the monthly plan, for €4.17 a month |
| Monthly | 14,99 € | So you never have to think about it again |
Prices are in euros, all taxes included. VAT not applicable, Article 293 B of the French General Tax Code. The subscription renews automatically at the end of each period and can be cancelled at any time from your account settings: cancellation takes effect at the end of the period already paid for, and nothing is charged afterwards.
Purchases made through the App Store or Google Play are billed by Apple or Google. In that case, refunds fall under their policies and must be requested from them, which is a constraint of their platforms and not a choice of ours.
5. Right of withdrawal
You have fourteen days to withdraw, under Articles L. 221-18 et seq. of the French Consumer Code. By requesting immediate access to the paid service, you request performance before the end of that period: you then keep your right, and the refund is calculated in proportion to what has been used.
6. What we guarantee, and what we do not
We do everything we can to keep the service available and your memory backed up. We do not, however, guarantee uninterrupted availability, nor the accuracy of what a language model understands from a sentence.
7. Suspension of an account
An account used in a manifestly abusive or unlawful way, or one that puts the service at risk, may be suspended. You are notified by email, with the reason, and you can retrieve your data before any deletion, unless the law forbids it.
8. Changes
These terms may change. Any substantial modification is announced by email at least thirty days before it takes effect. If it does not suit you, you may cancel free of charge during that period.
9. Governing law
French law. In the event of a dispute, an amicable solution is sought first at contact@memorypilot.fr. You may then refer the matter free of charge to a consumer mediator, or use the European online dispute resolution platform. Failing that, the French courts have jurisdiction.
